1) What is an Apostille

An Apostille is similar to an international notary stamp & authenticates the document so it can be used in another country. In California, the Secretary of State provides an Apostille to authenticate California Public Official signature(s) on documents to be used outside the United States. An apostille will ensure that your documents will be recognized as legitimate in all participating countries within the Hague Convention.

Country of Destination:

There are two types of countries of destination: Hague Convention and non -Hague Convention. Apostilles can only be issued for countries that belong to the Hague Convention. If your destination country is not a member of the Hague Convention this is considered a non-Hague Country & therefore would need to be “Authenticated” by U.S. Dept. Of Justice in Washington D.C. and/or Embassy Legalization for that respective country. Please see below for further information surrounding non-Hague Countries.

2) What Documents Can Be Apostilled?

Non Hague Countries:

Depending on the documents, some may require to be Apostilled at CA Secretary of State and then to U.S. Department of Justice in Washington D.C. to obtain Authentication. If the documents are Federal documents(I.e., Federal Backgrounds, Natural Certifications, etc..) then documents are directly sent to Washington D.C. for Authentication. Please call me directly for more detailed information regarding your non-Hague destination documents.

Most Common Reasons Apostilles Can Be Rejected:

  1. Birth/Death/Marriage/Divorce Certificate will not be Apostilled if the current C.A. State Registrar name/title, “or” County Clerk title “or” County Recorder title is not listed on the certificate. If the certificate is issued by a city/local county agency, the document will be rejected & you’d have to start the Apostille process all over again.
  2. The Notary Public’s signature on the notary certificate DOES NOT MATCH the Notary’s Public signature that’s on file with Secretary of State. This mistake is very common for rejection. As a trained Apostille Agent, I will ensure your documents are notarized with the same signature that is on file with the Secretary of State.
